The Department of Homeland Security (DHS) has announced that it was eliminating the Duration of Status (D/S) policy for F-1 and J-1 visas as of September 15, 2026. This discriminatory policy change will further complicate the visa renewal process for international students and scholars. When this was proposed in 2025 by the Trump Administration, tens of thousands of organizations and individuals submitted comments in opposition including our union, UAW International, and hundreds of UAW members.

What does this policy change mean in practice?

If you are in the U.S. on an F-1 or J-1 visa before September 15, 2026: If you leave the United States and reenter on or after September 15, 2026, you will be admitted with a Form I-94 containing a date-specific Admit Until Date (AUD), not to exceed four years. In addition, you must apply for an extension of stay with USCIS to remain in status beyond either (1) the program end date on your Form I-20 or DS-2019, or (2) four years from the rule’s effective date (November 14, 2030, for F-1s and October 15, 2030, for J-1s), whichever is earlier.
For F-1 and J-1 holders entering the U.S. on or after September 15, 2026: You will receive an Admit Until Date (AUD), a fixed end date for your authorized stay. The AUD will be limited to the program end date listed on your Form I-20, DS-2019, or OPT EAD, not to exceed four years, plus the applicable departure period after program completion.
